Wilders’trial has become a farce

The trial of MP Geert Wilders on charges of inciting hatred and discrimination took a new twist today when a senior court official wrote a weblog entry saying the legal proceedings should not have been suspended.

A special panel at Amsterdam district court halted the trial on October 22 and ordered it start again with new judges because the chief judge had acted in a way which could be prejudicial.

But writing in his own name on the legal blog njblog.nl, high court advocate general Diederik Aben said the case against Wilders should not have been suspended pending the appointment of new judges.

Supposedly, he wrote the item at the request of Amsterdam judge Jan Moors, who was at the centre of the controversy.

Wilders’ lawyer Bram Moszkovicz said it was ‘incomprehensible’ that a high court advocate general had made such a statement and said the trial had become a ‘farce’

Gerard Spong, a lawyer representing some of the people taking legal action against Wilders, said Aben was exercising his right to freedom of speech.

Nevertheless, the trial had become ‘a bit of a farce’, Spong said.

The trial should be removed from the Amsterdam court and continued elsewhere with new officials, he said.

The public prosecution department, which itself had been forced to take the case by the appeal court, asked for all charges against Wilders to be dismissed.

It is not clear when the trial will now take place.

Woman found dead in Wassenaar Mansion

Reineke de Lange (37) (photo) was found dead in her home, Villa Nijenorst, Koekoekslaan 3 in Wassenaar, The Netherlands. She was stabbed to death. 

At half past 1 her husband, self-made millionaire Jonkheer Jan H. de Lange (49) alarmed rescue services saying ‘something terrible had happened in the Villa. Jan de Lange was arrested.

Update: Reineke is the 2nd wife of Jonkheer de Lange, who just came out of a bitter divorce.
De Lange had an argument with his ex-partner regarding the alimony settlement. De Lange argued that he had to overdraw on Ltd (Pink & Nelson) in order to pay the alimony. An attempt to have his company act as an interested party in the alimony provisions was recently rejected by the Supreme Court.

Unless De Lange has confessed, is not at all certain that he has killed his wife: he has only called the police, saying “something had happened.”
On April 6, the Turk A. A. was aquitted for the second time (appeal) acquitted of murdering his wife Cevriye, for lack of evidence: His story: “I had been out cycling and when I came back my wife was dead.”  Stabbed with a bread knife, nine times,  in the back. Court and Appelate Court: “yes, that is not impossible.”

If the Jonkheer keeps his mouth shut and gets himself a good lawyer, chances are he will walk. “All of his neighbors do confirm that he was happy with his new wife. What reason could he have had to kill her your honor?”

Jan de Lange however, seemed very happy with his new –only six month old- marriage.
De Lange is  one of the sponsors behind the website 'geenonschuldigenvast.nl’, founded by Maurice de Hond pleading the ‘Deventer murder case’. 
De Lange also was the man who provided the 120,000 euros in damages for libel that Maurice de Hond had to pay to the “handyman”.

De Lange also funded several other projects that were critical towards the Justice department. Previously he had stated that the lawyers in his divorce case were ‘a bunch of feminist lesbians’

*Jonkheer is not a peerage title, but a ‘predicate’ used by titleless peers. One exception is the Orange Nassau family: Contrary to the rules of nobility, ‘Jonkheer’ is carried as a title (by the children of Jonkheer (‘Junker’) Claus von Amsberg). But then again: The House of Orange determines the rules of nobility in the Netherlands

Outrage over Joran van der Sloot is disproportionate

The outrage that has risen again about the recent "confession" of Joran van der Sloot, as usual takes on grotesque forms and really makes one wonder whether people commenting on forums even know what they're talking about.

‘Waterboarding in Guantanamo,’ ‘lock him up and throw away the key ‘, ‘a knee shot / head schot’, ‘torturing till he confesses,’ ‘he must speak the truth’, are the general remarks in various internet fora and discussion boards, apart from comments about his appearance from which some people seem to be able to read his "guilt" ( “upon only seeing his pig-like features, you already know that he is guilty”).

Guilty? To what then? What do people really want Joran to confess? He already confessed that he was present at the death of Natalee, and that he -helped by another- got rid of her body. Granted, there are 2 different stories, but his role in these stories remains the same. Varying statements are generally seen as even further evidence of guilt. That the DA’s office thinks that this is not enough for a conviction is their problem.

But suppose he is prosecuted abd convicted based on these confessions, what will be in store for Joran then? Unlawful disposition of a corpse carries a maximum 6 months sentence. Joran already served that in custody. Even with a conviction he will walk right out of the court because he already served his sentence. Ready, out, over!

Is Joran a nice person? Well, by now he doesn’t really seem so. Maybe he once was a nice guy to get a beer with, but like many children of ex-pats in the Antilles: money, nice weather, a constant fresh supply of female tourists, the relative carelessness of the ongoing holiday atmosphere on a tropical island probably made him feel like he could easily get away with things.

That someone of his age when suddenly faced with someone dying on him, does not think clearly and goes for a short term easy way out, is something I can understand –not condone, but understand. That subsequently one lie leads to another is wrong, foolish and stupid but it is human, despite the tragedy for the parents who lose their daughter. Nevertheless, after some time one should realize it is best to come clean. I can however imagine that the aggressiveness with which Beth Holloway, the world press and the FBI made him scared and head-shy thinking: "Well now I must hold on to my story." Inexcusable, stupid, but explainable. That he however now dragged and drags mony others (parents, the mysterious "A" and "Daury ') into it, is not so nice.

What do people really want Joran to confesses now that his confessions present only lead to more outrage? There is certainly a large group of people who want him to confesses the ‘truth’ as they see it in their own imagination. It seems that Joran will only be believed if he confesses he abducted the virgin Natalee, while she was reading a bible, has drugged her, horribly tortured her, raped her (in a gang-bang with 6 black guys), after which he laughingly fed her to the sharks alive for no other reasons that that pleased him. The more horrible the better for him to be believed by a number of people.

Is it likely that Joran killed Natalee? No. Granted, we know nothing for certain but there is nothing to suggest that Joran was violent. Given the stories and photos on his blog, he could get enough girlfriends and one night stands and there is nothing to suggest that Natalee was not in for a bit of holiday romance.

I’ll just stick to the belief that he is only guilty of disposing of a body, for which which he -uncondemned- has already served the maximum sentence. One can certainly blame for him for waiting so long before he confessed what has happened and it he is certainly to blame for telling several versions, including the story in which he implied his father that he sold to Fox’ Greta van Susteren for 100,000 USD.

Joran is obviously not in an enviable position. His education came to a halt and he became public enemy number one, with a recognizable face and a recognizable name. His future has been smashed (yes, I know Natalee has no future and her parents have a ‘life sentence’, but that's not the point here) and he will need to find a way to generate income. Apparently he does that selling his story time after time, and fair is fair, he does not have many other options and people can hardely dislike him even more than he already is.

Yet the public outrage is disproportionate if for example one looks at other people who have something to answer for:

  1. Hugo Nijkamp, who beheaded his girlfriend Vanessa Williams in Suriname, escaped and subsequently got government contracts. After he was exposed he was sentenced to 5 years imprisonment. Apart from some public outrage when his case got some attention again, everybody already forgot about him and he can soon get back to work as a free man.
  2. People like the very violent Genneper Park Rapist, or Manno K. who ‘fist raped’ his ex-girlfriend into a permanent anal incontinence needing an anus prenaturalis (a "stoma") and into mental break down, are in general much more deserving of our outrage than Joran van der Sloot. Yet they remain in reasonable anonymity, spared from the 'Gesundenes Volksempfinden' and after serving their relatively low sentence of 4 years they again pick up their lives undisturbed.
  3. The Red Light District in Amsterdam (or in any other city), is filled with an army of woman-traffickers, rapists and abusers. They live in anonymity and even if they are prosecuted and convicted their names and mugshots rarely make the newspaper headlines and people will certainly not be stirred up against them as did SBS6 against Joran the Natalee Holloway case.

 
Joran is certainly not choir boy, but I think the witch hunt set upon him, instead of upon much shadier characters, says more about society than about Joran.

Albayrak does not want to extradite Joma Sison

According to under minister Albayrak, the Netherlands wil not extradite Filipino communistenleader José Maria Sison* for now.

She writes that as a reply to questions of the PVV, who wants to have Sison removed from the Netherlands ASAP.

Albayrak  agrees with Geert Wilders’ fraction that the Netherlands can be no free heaven for terrorists and criminals and that Sison should answer to a judge in the Philippines for the anguish he supposedly caused there. However she also says that she has to respect Human Rights and International treaties, such as the European Treaty of Human Rights.

Op grounds of article 3 of the Treaty it is not possible to extradite Sison because the article states that no one may be subject to torture or inhumane or humiliating treatment or punishment. The fact that the death penalty is abolished in the Philippines does not make any difference according to Albayrak.

The Public Prosecutors Office stopped prosecuting Sison earlier this year for his supposed role in 3 murders in the Philippines because of lack of evidence. The founder of the Communist Party of the Philippines (CPP) and her armed branch the New People's Army (NPA) (Tagalog: Bagong Hukbong Bayan) was arrested end of August 2007 in his residence Utrecht. Sison was suspected of ordering the murders of two political opponents Romulo Kintanar (2003) en Arturo Tabara (2004), committed in the Philippines. During the murder in 2004 also Tabara's son in law, Stephen Ong was killed.

Eventhough the Netherlands cannot extradite Sison (according to Albayrak), he is obliged to leave the country. However, Albayrak doubts this is possible because the chance that another country will just send the man back to the Netherlands. (Or preferably to the Philippines of course)

This in itself is odd because if Sison indeed cannot be extradited to the Philippines (something I question) then there still is an extremely suitable country to offer refuge to JoMa Sison: North Korea.

From the link: Greetings To Comrade Kim Jong Il on his Birthday it is clear that the North Korean ruler is admired highly by the CPP and NDFP (National Democratic Front of the Philippines) for ‘what he has meant to North Korea'.

And who do we find on this list of ‘dignitaries’ who fall over themselves in gratulating Kim Il Young with his Birthday? The JoMa Sison croonies Louis Jalandoni en his wife Coni Ledesma. Fellow founders of the  CPP and founders of the (forbidden) NDFP. Ledesma is also an avid 'spokeswoman' for Sison.

With such cordial ties between the  CPP/NDFP surely there must be some place for Sison in Noord Korea?

One cannot help but wonder why Sison (and also Ledesma and Jalandoni) are seeking refuge in the Netherlands rather than in the so admired North Korea.

The Hunt for Malika Karoum | more Gossip but now in a book

malika boek2 The story of Malika Karoum is no doubt widespread by now: Spy, Mata Hari, Fraud, Money-laundering but all these stories seem to go back to gossip spread by her ex-husband and a fundamentalistic kid-hunter in  what is not more than an ugly custody battle.

Now there is a book (“Klopjacht op Malika” = “The Hunt for Malika”) about the story that in its announcements promised to finally reveal the truth. The fact that the book is written by Jan Libbenga, a reporter for Dutch Tabloid ‘Revu’, should cast some doubt about that statement. Libbenga after all,  ‘broke the story’ about Malika’s alleged Mata-Hari life.

Reading the book indeed confirms that suspicion. It is ‘more of the same’. There is ample space for kid-hunter Jacques Smit to repeat the unfounded gossip he has been spreading in the past, but now it is ‘substantiated’ by the stories of a certain ‘Rafiq’ who supposedly is the man who ‘supposedly’ contracted and trained Malika to work for ‘the intelligence service’.

Rafiq has no reliability. There is no proof for any of his stories and he could be anyTom, Dick or Harry, with a big fantasy, that was picked of the street.

One thing is clear: Rafiq is mentally instable. After Malika (alledgedly) informs him that she is quitting. He has an emotional meltdown that includes black-outs and a trance state in which he ended up in the Netherlands without remembering how. Typically the sort of guy that would get through the rigourous mental selection spies are said to go through.

It is all beautiful stories, but again, not a shread of convincing proof

It only proves that gossip can ruin a person's life

Malika Karoum accuses ex-husband of smear campaign

Dutch Tabloid ‘Revu’ last week published an article about Dubai real estate executive Malika Karoum, describing how she was extradited from Dubai to Egypt and sentenced to 28 months jail time for money laundering.

Like all stories about Malika Karoum, this latest story is also a fluke. In an interview with Dubai’s 24/7’s  Muna Ahmad, Karoum says these stories are made up by her ex husband to damage her reputation, career and life.

"This whole story has been created by my ex-husband and his private detective," she said. "I was shocked to see my picture on the front page of your paper. I am Malika Karoum and I have been living and working in Dubai for the past three years.

"I have no problem with any authorities or police. Call any of my ex-employees and check with them. The only correct thing in this article is that I have worked for Omniyat, Define and ACI.

"My ex-husband started this and there is a long dispute between us over custody rights for our son. He says anything to destroy me and destroy my reputation by saying I am a spy and mafia and a fraud."

Karoum alleged her ex-husband was a fugitive and accused him of spreading lies about her on the internet. "All these blogs are created by my ex-husband and a private detective. He has been doing this for the past six years through my family and friends. When it didn't work he started with the media."

This is not the first time Karoum is the victim of wrongful claims in tabloid ‘Revu’. The rumours are spread by an overzelous private investigator and child abductor Jaques Smit. These stories sadly have been copied critique-less by other media.

At the end of 2008 however, there seemed to be a brief turning point: Ex husband Mohamed Boulnouar fled after stealing a large sum of money from Muslims wanting to travel to Saoudi Arabia for the Hadj and child-abductor Smits was put on tape, admitting all the allegations were not true. When the court appointed custody of her child to Malika in december 2008, it seemed the end of the story.

Unfortunately nothing was further from the truth as Boulnouar and Smits seem to be at it again with their gossip. Gossip that serves no other purpose than to damage Karoum’s career.

On various occasions the Dutch Justice Department has declared that Karoum is not a suspect in any criminal case. The allegations were and are false.

Customer beaten to death by cab driver

Rob Sitek (44), a father of three, was beaten so severely by taxi driver Sidi Mohamed Belghiti (37) from Den Haag/The Hague, Sunday morning on Leidseplein in Amsterdam, that he died shortly thereafter in the hospital. Sitek wanted to take a cab home but thought the price was inflated. Reason for the cab driver, a former Moroccan kickboxer to beat him full in the face. Belghiti was arrested by policemen witnessing the scene.

Paramedics seemed to initially be able to revive the severely injured  man. That same afternoon however he died in a hospital without having regained consciousness.

The crime took place around 4.20 am at the taxistand at leidseplein. Sitek had said goodbye to his brother André with whom he had been out and had wanted to eat a snack before taking a taxi home. There have been complaints about the cabdrivers at this spot for some time already. They refuse short rides, inflate prices, take customers for a ride, fight, intimidate customers and hassle women. Leidseplein however is not the only taxi trouble spot in Amsterdam. In fact, taking a taxi anywhere in Amsterdam is a big risk, both for your wallet, as well for yor safety..

Job –try to keep things together by drinking tea- Cohen fortunately is ‘shocked’. Well, I guess it all will be allright then.

Amsterdam alderman  Hans Gerson (63) (traffic) wants to take emergency measures at Leidseplein. He said that most likely next weak already, extra watchmen will be placed at Leidseplein, as already has been done since june at the taxi stand at Central Station, another known trouble spot regarding cabbie behaviour. 

The alderman also is going to insist to politicians in The Hague to speed up the new taxi-law. The problems in the Amsterdam taxi wold –according to the alderman- begun in 2000 when the scene was liberalised. Ever since everybody may operate a cab. De  „We have slowly come into a well known emergency situation, so it should not be so difficult to get this done” said alderman Gerson.

 

 

 

Ron Sitek, paramedic of the year, was also priviliged to get acquainted with the tolerance of certain ‘new’ Dutch citizens.

Ron Sitek himself received death threaths last year while he was tending to a Moroccan man who was stabbed. He received these threaths from the brother of the victim. VZA-ambulance service went on strike out of protest that same night.

Rob Sitek, is father to three daugthers: two teenagers and one of 11 months old. The family is shaken by the taxi violence. They say that the violence could easily have been prevented if government had taken action against the violence in the taxi world earlier. Thanks a lot The Hague [The Hague is where the government is]'', “says Sitek. Amsterdamse mayor Job Cohen (61) (labour) has called Sitek ‘personally’ on Sunday, to offer his condoleances. He is  -the standard phrase for Dutch politicians- 'shocked' by the incident.

“If he dies I kill you” is what paramedic Ron Sitek was tolld last year while he was trying to save a life. On June 17 juni,  Abdullah S., who threathened Ron, was sentenced to  30 uur hours of community service. He also received a jailsentence of 30 day, of which 14 where suspended. He already had spent 16 days in custody so he could walk right out of court.

Mayor Cohen, in a fast reaction, wanted a new taxi law fast. In that he is right. If there is one business where there is daily proof that an open market can spiral out of control, then it is the Amsterdam taxi-business.

State-traffic-secretary Tineke Huizinga (photo)  (Christen Unie) has promised to send a letter to the House this week in which she proposes to give local government more authority in the taxi world. Apparently, the driver exam that was put in plae in 2004 turned out to be of little effect in controlling the taxi business.

Well, this might be so, but one can hardly blame the mechanism of open market for what has now happened. The liberalisation of the taxi world to an open market has been law since 2000 in the whole of the Netherlands, whereas the problems seem to focus in Amsterdam.

Ther eis, in Amsterdam, with or without open market, a problem with public law and order. Thát is something that mayor Cohen and the police brass, should realise and feel responsible for and in fact be very very ashamed off. Also the most liberal opem market taxi law does not allow the frauding and killing of customers. That is already forbidden, by general law.
